Poland's disability pension is available to people who cannot work due to their health. Check the conditions, amount, and how to apply through ZUS in 2026.

The disability pension (renta z tytułu niezdolności do pracy, colloquially called an "invalid's pension") is a benefit from disability insurance paid by ZUS to people who, due to illness or injury, have lost the ability to perform paid work. It is a separate benefit from the social pension (renta socjalna), which is aimed at people disabled from birth or early childhood.

Types of incapacity to work

ZUS distinguishes two degrees of incapacity to work:

  • Total incapacity to work — the person is unable to perform any paid work under normal employment conditions. Entitles the holder to a higher pension.
  • Partial incapacity to work — the person has lost at least half their ability to work in their previous position or profession. The pension is lower.
  • Training pension (renta szkoleniowa) — granted for 6 months (extendable) to a person who, for health reasons, requires professional retraining.

Conditions for granting the pension

To receive a disability pension, two conditions must be met together:

  1. A certificate from a ZUS medical assessor confirming incapacity to work.
  2. An adequate insurance record (contribution and non-contribution periods), depending on the age at which the incapacity arose:
    • up to age 20 — 1 year of insurance record,
    • ages 20–22 — 2 years,
    • ages 22–25 — 3 years,
    • ages 25–30 — 4 years,
    • over age 30 — 5 years within the last 10 years before filing the application or the date the incapacity arose.

The insurance record requirement doesn't have to be met if the incapacity to work was caused by an accident on the way to or from work.

How much is the pension

The amount of the disability pension depends on:

  • accumulated retirement contributions (the capital in your ZUS account),
  • the length of contribution and non-contribution periods,
  • the degree of incapacity to work.

The pension cannot be lower than the minimum pension, which (as of March 2024) is:

  • total incapacity to work: 1,901.71 PLN gross,
  • partial incapacity to work: 1,426.29 PLN gross.

These amounts are adjusted annually for inflation.

Assessment — the ZUS panel

Incapacity to work is assessed by a ZUS medical assessor. Their decision can be appealed to the ZUS medical board, and then to the labor and social insurance court. It's worth gathering complete medical documentation before the first assessment, including test results, medical history, and opinions from specialists.

Social pension vs. disability pension

These are two separate benefits:

  • Disability pension (renta z tytułu niezdolności do pracy) — requires an insurance record, tied to employment history.
  • Social pension (renta socjalna) — for people whose incapacity to work arose before age 18 (or 25, if in education). Does not require a contribution record.

How to apply

The application (form ZUS Rp-1) is submitted at the ZUS branch or inspectorate covering your place of residence. The application must include medical documentation, an employer's salary certificate (form ZUS Rp-7), and documents confirming insurance periods.

Frequently asked questions about the disability pension

How long does it take to have the pension granted?

ZUS has 30 days to issue a decision from the date of a complete application (or 60 days if circumstances need to be clarified). In practice, processing can take longer, especially if additional examinations or documents are required.

Can you work while receiving a disability pension?

Yes, but with limits. While receiving a partial incapacity pension you can work, but earnings above 70% of the average salary may cause the pension to be suspended or reduced. For total incapacity, the limits are stricter. It's always worth notifying ZUS when you take up work.

What's the difference between a permanent and a fixed-term pension?

A permanent pension is granted when the incapacity to work is deemed long-term (with no expected improvement). A fixed-term pension is granted for a set period when the incapacity may resolve. A new medical assessment is required once the period ends.

How much is the minimum disability pension?

Since March 2024, the minimum pension for total incapacity is 1,901.71 PLN gross, and for partial incapacity — 1,426.29 PLN gross. These amounts are adjusted annually every March.

Is the pension taxed?

Yes. The disability pension is subject to personal income tax. ZUS withholds a tax advance. The recipient files a PIT return like any other individual.

Can I appeal a ZUS medical assessor's decision?

Yes. An appeal is filed with the ZUS medical board within 14 days of receiving the decision. If the board upholds the negative decision, you can appeal to the labor and social insurance court.

What happens to the pension once you reach retirement age?

Upon reaching the standard retirement age (60 for women, 65 for men), the disability pension is automatically converted into a retirement pension, if that is more favorable. ZUS compares the two and pays out the higher benefit.

Can a self-employed person get a disability pension?

Yes, if the insurance record condition is met (periods of paying disability contributions as a self-employed person count toward the record). The ZUS assessor evaluates incapacity regardless of the form of employment.

How should I prepare medical documentation before an appointment with the ZUS assessor?

It's worth gathering your full medical history: lab and imaging test results, opinions from specialists, hospitalization records, and outpatient treatment certificates. The more complete the documentation, the better the basis for assessment.

Can a social pension and a disability pension be received at the same time?

As a rule, you cannot receive both pensions simultaneously. If a person receiving a social pension becomes entitled to a disability pension, ZUS will grant the higher of the two benefits.
