Labour law in Poland — employee rights

The Polish Labour Code guarantees at least 20 days of annual leave (26 after 10 years), paid sick leave and severance pay. The leave calculator accounts for seniority; the overtime calculator applies 50% and 100% premium rates.

How many days of annual leave does an employee get?

Employees with < 10 years of service get 20 days; those with ≥ 10 years get 26 days per year.

How to calculate overtime pay?

Weekday and daily overtime: 50% premium; overnight, Sunday and public holiday overtime: 100%.

How long is the notice period?

Notice period: 2 weeks (< 6 months), 1 month (6 months–3 years), 3 months (≥ 3 years of service).

Economic redundancy pay: 1 monthly salary (< 2 years), 2 months (2–8 years), 3 months (> 8 years).

The minimum wage from 01.07.2024 is 4,300 PLN gross.

Cash-out = (monthly salary / 21 working days) × number of unused leave days.

Work beyond 8 hours per day or 40 hours per week is overtime — it requires employer authorisation.

Unemployment benefit is 80–120% of the base amount (approx. 1,491–1,867 PLN gross) depending on seniority.

A fixed-term contract can be entered into max. 3 times, totalling up to 33 months; then it becomes permanent.

An employer may only deduct: advances, employee contributions, alimony and disciplinary fines (with consent or by law).
