The night premium arising from the Labour Code is due to employees on an employment contract. Under a contract of mandate (umowa zlecenie) the pay terms, including any night-work premiums, are set by the civil-law contract itself. A contractor is, however, guaranteed a minimum hourly rate, which in 2026 is also indexed.

Yes. If night work is also overtime, the employee is entitled to both: the night-work premium (20% of the minimum rate) and the overtime premium (50% or 100% of pay). These are two separate entitlements and do not exclude each other.
